The website www.dachainz.com, hereinafter referred to as “the Site,” is published and operated by DA CHAINZ BV, a private limited company registered in Belgium with the Crossroads Bank for Enterprises (CBE/KBO) under the number 1015.602.371, with its registered office at Lindelaan 3, 3550 Heusden-Zolder.
The Site is freely accessible and free of charge to any Internet user. Its purpose is the presentation and retail sale of adult collectible items.
Article 1 – Scope
These General Terms and Conditions of Sale (hereinafter referred to as “GTC”) apply, without restriction or reservation, to all sales concluded by DA CHAINZ BV, referred to as “the Seller,” to buyers, referred to as “the Customer,” wishing to purchase the Products offered for sale on the Site. The validation of the order by the Customer implies full acceptance of these GTC. The version applicable is that which is online at the time of the order.
Article 2 – Products & "Not a Toy" Disclaimer
The main characteristics of the Products are presented on the Site. The Customer is required to be aware of them before placing an order. Important: All Products sold on this Site are decorative adult collectibles intended for individuals aged 14 years and older. They are not toys and are not intended for children.
Article 3 – Prices
Prices are expressed in Euros (€), All Taxes Included (Belgian VAT), excluding delivery charges. The Seller reserves the right to change prices at any time, but Products will be invoiced based on the rates in effect at the time of order registration. Delivery charges are calculated and indicated prior to final validation.
Article 4 – Payment Conditions
Payment is due in full on the day of ordering. Payment is made via secure methods (Credit Card, etc.) provided by the authorized payment service provider on the Site. Ownership of the Products remains with the Seller until the full price has been paid.
Article 5 – Delivery & Geographic Scope
We currently only ship to countries within the European Union. Delivery is provided by independent carriers. For specific details on times and rates, please consult our “Shipping & Returns” page.
Article 6 – Right of Withdrawal (EU Law)
In accordance with EU consumer protection laws, the Customer has a period of 14 days from receipt of the Product to exercise their right of withdrawal without having to justify reasons.
- Condition: To be eligible for a refund, the Product must be returned in its original, unopened collector packaging (including any seals or bands).
- Shipping: Return shipping costs are the sole responsibility of the Customer.
- Article 7 – Intellectual Property
The content of the Site, including 3D models, artistic designs, and the "DA CHAINZ" brand, is the property of the Seller and is protected by Belgian and international intellectual property laws. Any total or partial reproduction is strictly prohibited.
Article 8 – Limitation of Liability
The photographs and visuals of the Products are as representative as possible. However, as these are high-end collectibles often involving hand-finished elements, minor variations may occur and do not constitute a lack of conformity. The Seller cannot be held liable for technical interruptions of the Site beyond its control.
Article 9 – Applicable Law & Disputes
These GTC are governed by Belgian law. In the event of a dispute, the Customer and Seller shall first seek an amicable solution. The Customer is informed that they can resort to the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr. Any dispute not resolved amicably shall be subject to the exclusive jurisdiction of the courts of Antwerp, Division Hasselt.
